Terms of sale

1. Seller

The artworks by Jéssica Domínguez offered on this website are sold and invoiced by RETIVEL S.L., tax ID B67548610, registered office at Calle Vilamarí, 86, 08015 Barcelona (Spain). Contact: hola@jessicadominguezart.com.

These terms apply to purchases made on jessicadominguezart.com. By completing a purchase, you accept these terms.

2. The artworks

• Each artwork is a unique, original, hand-painted piece, signed by the artist and accompanied by a certificate of authenticity.
• Dimensions refer to the artwork itself. As handmade work, there may be slight variations in texture and colour compared with the photographs; these are part of its nature.
• Artworks are sold unframed unless the listing expressly states that they are delivered framed. Photographs showing framed work or work in a room are for illustration only. Framing can be requested as an extra, subject to a prior quote.

3. Prices

Prices are shown in euros and include the applicable Spanish VAT. The shipping cost is shown before payment and added to the price of the artwork, except in mainland Spain, where it is included. For deliveries outside the European Union, customs duties, taxes and import fees in the destination country are not included and are paid by the recipient.

4. How to buy

• On the artwork page, click Buy, enter the shipping country and postcode and check the total (artwork + shipping).
• Payment is made on Stripe's secure platform, using the methods available in your country (card, PayPal, Apple Pay, Google Pay and others).
• Once the payment is completed you will receive a confirmation and receipt by email. The contract is concluded at that moment.
• As each artwork is unique, if two people try to buy the same piece at the same time, the first completed payment prevails and the other will be refunded in full.
• If direct shipping is not available to your destination, or the artwork is larger than 20 × 20 cm, you can request a custom shipping quote from the artwork page.

5. Shipping and delivery

Shipping zones, costs and delivery times are detailed on the shipping and customs page. Artworks are prepared within 2 to 4 working days and travel packed, tracked and insured. We will send you the tracking number once your order leaves the studio.

If the artwork arrives damaged, please let us know within 48 hours of delivery at hola@jessicadominguezart.com, with photographs of the packaging and the piece, so that we can arrange repair, replacement or a refund.

6. Right of withdrawal (available artwork)

If you are a consumer, you have 14 calendar days from receiving the artwork to withdraw from the purchase without giving any reason.

• To exercise this right, send us a clear statement by email to hola@jessicadominguezart.com (you may use the model form below).
• You must return the artwork in the same condition in which you received it, properly packed, within 14 calendar days of notifying us of your withdrawal. Return shipping costs are paid by you.
• We will refund the price of the artwork and the standard shipping cost paid within 14 calendar days of your notification, using the same payment method. We may withhold the refund until we have received the artwork back.
• You are liable for any loss in value of the artwork resulting from handling beyond what is necessary to establish its nature and characteristics.

Exception: the right of withdrawal does not apply to commissioned or personalised artwork made to your specifications.

7. Guarantee

Artworks are covered by the legal guarantee of conformity provided for in consumer protection law. If you find a lack of conformity, please write to hola@jessicadominguezart.com.

Studies on fabric remnants. These are study pieces painted in short sessions and they keep marks of the process: raw edges, traces of gesso, small marks or irregularities of the fabric itself. These features are described on each page and can be seen in the photographs; they are part of the work and do not constitute a lack of conformity. They are sold unframed, and framing is at the buyer’s expense. The right of withdrawal remains as set out in section 6, with return shipping paid by the buyer. Custom remnants are treated as commissions (section 8) and cannot be returned.

8. Commissions

• Each commission is quoted individually. The quote sets out the price, dimensions, timeframe and shipping.
• A commission is confirmed with a 40% deposit, which reserves the work and covers materials and time. The remaining 60% is paid before shipping, once you have approved photographs of the finished piece.
• Usual timeframe: 4 to 6 weeks from approval of the proposal. Up to two minor adjustments are included; changes of concept after approval may require a new quote.
• As personalised work, commissions cannot be withdrawn from, except in the case of damage in transit.

9. Intellectual property

Buying an artwork transfers ownership of the physical piece but not the reproduction rights or any other exploitation rights, which remain with the artist.

10. Governing law and complaints

These terms are governed by Spanish law, without prejudice to any mandatory consumer protection rules of your country of residence. For any question or complaint, write to hola@jessicadominguezart.com and we will reply as soon as possible. Consumers may bring proceedings before the courts of their place of residence.
